The agreement between you and Mount Mob when you book a job with us.

These Terms and Conditions ("Terms") constitute a legal agreement between [LEGAL ENTITY NAME], doing business as Mount Mob ("Mount Mob," "we," "us," or "our"), and the individual or entity requesting, booking, purchasing, or receiving services from Mount Mob ("Customer," "you," or "your").

By using the Mount Mob website, submitting a service request, approving a quote, scheduling an appointment, making a payment, or permitting Mount Mob personnel to begin work, you agree to be bound by these Terms.

If you do not agree to these Terms, you should not book or authorize Mount Mob to perform services.

  1. 1. Definitions

    • Customer: The individual or entity requesting, purchasing, or receiving services from Mount Mob.
    • Services: TV mounting, installation, assembly, cabling, device installation, handyman services, or other services offered by Mount Mob and identified in a quote, booking, invoice, or service description.
    • Property: The residence, commercial property, or other location where Services are performed.
    • Quote: An estimate or proposed price provided by Mount Mob based on the information available at the time.
    • Work Order: The final scope of Services authorized by the Customer.
    • Additional Work: Labor, materials, equipment, additional personnel, additional visits, or services outside the original quoted scope.
  2. 2. Services

    Mount Mob provides professional installation and related home or commercial services as described on its website, booking system, quotes, invoices, and communications with Customers.

    The exact scope of work for a particular appointment is determined by the Services selected by the Customer and any additional work approved before or during the appointment.

    Mount Mob may decline any requested work that it reasonably believes is unsafe, unlawful, outside the scope of its services, or requires licensing, equipment, expertise, or conditions that are not available.

  3. 3. Estimates, Quotes, and Final Pricing

    Quotes are based on the information provided by the Customer and the conditions reasonably known to Mount Mob before the appointment.

    Unless expressly identified as a fixed-price quote, prices shown online, during booking, or before an inspection are estimates.

    Final pricing may change if the actual scope, site conditions, installation complexity, wall or surface material, equipment, requested configuration, number of installers required, access conditions, travel requirements, or other circumstances differ from the information provided during booking.

    Examples of circumstances that may result in additional charges include:

    • concrete, brick, stone, tile, metal, or other specialty mounting surfaces;
    • unusually large or heavy televisions or equipment;
    • installation above fireplaces or in difficult-to-access locations;
    • specialty mounting hardware;
    • concealed wiring or cable routing;
    • additional devices or accessories;
    • additional labor;
    • additional installers;
    • structural or surface conditions not visible before work begins;
    • Customer-requested modifications to the original scope.

    Mount Mob will disclose additional charges to the Customer before performing Additional Work requiring an additional charge.

    If the Customer declines the revised scope or price, Mount Mob may stop work and charge for Services already performed, materials already used or purchased, and any applicable service or dispatch charges.

  4. 4. Additional Installers and Complex Jobs

    Mount Mob determines the number of installers reasonably necessary to perform Services safely and efficiently.

    Certain installations may require additional installers because of equipment weight, installation height, job duration, physical access, complexity, safety considerations, or other job-specific conditions.

    Additional installer charges may apply when disclosed as part of the final quote or revised scope.

    The need for additional personnel does not necessarily mean that the original booking information was incorrect; certain requirements may only become apparent after reviewing the complete scope of the project.

  5. 5. Booking and Scheduling

    Appointments are subject to availability.

    A requested appointment date or time is not guaranteed until confirmed by Mount Mob.

    Arrival times may be provided as a service window rather than an exact time.

    Mount Mob may adjust an appointment because of traffic, weather, unexpected job duration, technician availability, emergencies, unsafe conditions, or other circumstances outside its reasonable control.

    Mount Mob will use reasonable efforts to notify the Customer of significant scheduling changes.

  6. 6. Customer Responsibilities

    The Customer agrees to:

    • provide accurate information about the requested Services;
    • provide accurate information about the television, mount, devices, wall type, property, and installation location when requested;
    • disclose known hazards or unusual conditions;
    • provide safe and reasonable access to the Property and work area;
    • ensure that an adult authorized to approve work is present or otherwise available during the appointment;
    • remove fragile, valuable, or obstructing items from the work area;
    • ensure that pets, children, and other occupants do not interfere with the work area;
    • obtain any required landlord, property-management, HOA, or building approvals;
    • identify any known utilities, plumbing, electrical wiring, gas lines, security systems, or other concealed conditions that may affect the work.

    Mount Mob is entitled to rely on information provided by the Customer.

  7. 7. Property Access

    The Customer represents that they own the Property or have authority from the owner to authorize the requested Services.

    By permitting Mount Mob personnel to enter the Property, the Customer authorizes reasonable access to the areas necessary to perform the Services.

    If Mount Mob cannot access the Property or work area at the scheduled time, a cancellation, rescheduling, or service-call fee may apply.

  8. 8. Wall, Surface, and Structural Conditions

    Mount Mob will use reasonable professional judgment when selecting installation methods and hardware.

    However, Mount Mob cannot guarantee the internal condition of walls, ceilings, studs, framing, masonry, electrical systems, plumbing, or other concealed structures.

    The Customer acknowledges that certain conditions may not be discoverable until drilling, cutting, removing an existing installation, opening a surface, or otherwise beginning work.

    Mount Mob may suspend work if it discovers conditions that make the requested installation unsafe or materially different from the quoted scope.

    Such conditions may require a revised quote, different hardware, additional labor, another installer, another service provider, or cancellation of the affected portion of the work.

  9. 9. Concealed Utilities and Hidden Conditions

    Mount Mob will exercise reasonable care when drilling, fastening, cutting, or performing similar work.

    However, concealed electrical wiring, plumbing, gas lines, low-voltage wiring, structural components, previous repairs, or other hidden conditions may exist in locations that cannot reasonably be identified before work begins.

    To the extent permitted by law, Mount Mob is not responsible for damage resulting from hidden or undisclosed conditions that could not reasonably have been detected using normal installation practices.

    This limitation does not apply to damage caused by Mount Mob's gross negligence or willful misconduct.

  10. 10. Customer-Supplied Equipment

    Customers may provide televisions, mounts, cables, brackets, hardware, electronics, furniture, or other equipment for installation.

    Mount Mob is not responsible for defects, compatibility issues, missing components, manufacturer defects, inadequate load ratings, or failures involving Customer-supplied products.

    If Customer-supplied equipment cannot safely or properly be installed, Mount Mob may refuse to install it.

    Additional charges may apply if replacement hardware, equipment, or additional labor is required.

  11. 11. Materials and Mounting Hardware

    Unless otherwise stated in the quote, specialty hardware, cables, mounts, brackets, adapters, electrical components, or other materials may be billed separately.

    Mount Mob may substitute functionally equivalent hardware when reasonably necessary to complete an installation safely.

    Any material pricing will be disclosed when applicable.

  12. 12. Changes Requested During Service

    If the Customer requests additional work after the appointment begins, Mount Mob may provide a revised price before performing that work.

    Verbal, written, electronic, or in-person approval of an additional charge constitutes authorization to perform the Additional Work.

    Mount Mob is not required to perform requested Additional Work if doing so would interfere with scheduling, create a safety concern, require unavailable materials, or fall outside the Services Mount Mob provides.

  13. 13. Additional Visits

    Mount Mob may determine that an additional visit is necessary to complete a job.

    An additional visit will not be charged solely because Mount Mob needs additional time to complete work that was included in the agreed scope, unless otherwise disclosed in the quote.

    Additional visit charges may apply when a return visit is required because of:

    • changes requested by the Customer;
    • inaccurate or incomplete information provided by the Customer;
    • unavailable or incompatible Customer-supplied equipment;
    • inaccessible work areas;
    • missing approvals;
    • conditions discovered at the Property;
    • work performed by another contractor;
    • Customer cancellation or inability to provide access;
    • circumstances outside Mount Mob's reasonable control.

    Any applicable charge will be disclosed before the additional paid visit is scheduled.

  14. 14. Payment

    The Customer agrees to pay all charges approved in connection with the Services.

    Payment may be required before, during, or immediately after completion of the Services, depending on the applicable booking or quote.

    All prices are stated in U.S. dollars unless otherwise indicated.

    Applicable taxes, fees, materials, or approved Additional Work may be added to the final invoice.

    By providing payment information, the Customer represents that they are authorized to use the selected payment method.

  15. 15. Deposits

    Mount Mob may require a deposit for certain appointments, large projects, specialty materials, or custom work.

    Any applicable deposit requirements will be disclosed before payment.

    Deposits may be applied toward the final invoice.

    The refundability of a deposit will depend on the applicable quote, cancellation policy, materials purchased, work already performed, and applicable law.

  16. 16. Cancellations and Rescheduling

    Customers should provide reasonable notice when canceling or rescheduling an appointment.

    Mount Mob may establish cancellation or rescheduling fees for appointments canceled with insufficient notice, missed appointments, or situations where installers arrive but cannot perform the work because the Customer is unavailable or the Property is inaccessible.

    Any applicable cancellation policy presented during booking or in the quote becomes part of these Terms.

    Mount Mob may cancel or reschedule an appointment without liability when reasonably necessary because of safety concerns, weather, technician availability, equipment failure, emergencies, or other circumstances beyond its reasonable control.

  17. 17. Completion and Customer Inspection

    The Customer should inspect completed work before the installer leaves whenever reasonably possible.

    Any visible concern regarding placement, alignment, installation, or workmanship should be raised promptly.

    Customer approval of completed work does not waive any warranty rights provided under these Terms or applicable law.

  18. 18. Service Warranty

    Mount Mob warrants that its installation labor will be performed in a professional and workmanlike manner.

    If an installation issue results directly from Mount Mob's workmanship, the Customer must notify Mount Mob within [WARRANTY PERIOD] after completion.

    Mount Mob will determine, after reasonable inspection, whether the issue is covered.

    For covered workmanship claims, Mount Mob's obligation will generally be limited to correcting the affected installation.

    The workmanship warranty does not cover:

    • manufacturer defects;
    • Customer-supplied equipment failure;
    • normal wear and tear;
    • misuse or abuse;
    • modifications by the Customer or a third party;
    • movement or alteration of installed equipment;
    • structural movement;
    • water damage;
    • electrical surges;
    • accidental damage;
    • hidden wall or structural conditions;
    • failure of materials or equipment not supplied by Mount Mob.

    Manufacturer warranties remain subject to the applicable manufacturer's terms.

  19. 19. Damage and Pre-Existing Conditions

    Mount Mob is not responsible for pre-existing damage or defects at the Property.

    This includes damaged drywall, weak framing, previously drilled holes, deteriorated surfaces, loose tile, existing wiring issues, defective equipment, previous installation damage, or other conditions existing before Mount Mob begins work.

    Mount Mob may photograph or otherwise document the work area before, during, or after service for quality, safety, documentation, or dispute-resolution purposes, subject to applicable privacy law.

  20. 20. Safety

    Mount Mob personnel may stop or refuse work when conditions are unsafe.

    Examples include unstable structures, unsafe electrical conditions, hazardous materials, inadequate access, dangerous mounting locations, aggressive animals, threatening behavior, or environments that expose personnel or property to unreasonable risk.

    The Customer remains responsible for correcting unsafe Property conditions.

  21. 21. Third-Party Products and Services

    Mount Mob may install, recommend, link to, or work with products and services provided by third parties.

    Third-party products and services are governed by their own warranties, policies, and terms.

    Mount Mob does not control and is not responsible for the performance, availability, compatibility, security, or continued operation of third-party products or services.

  22. 22. Website Use and Intellectual Property

    The Mount Mob website, branding, logos, designs, text, graphics, photographs, software, and other content are owned by or licensed to Mount Mob and are protected by applicable intellectual-property laws.

    Users may not copy, reproduce, distribute, modify, republish, scrape, reverse engineer, exploit, or commercially use Mount Mob website content without prior written authorization.

    Nothing in these Terms transfers ownership of Mount Mob intellectual property to the Customer.

  23. 23. Photos and Documentation

    Mount Mob may take photographs of installation areas before, during, or after service for internal documentation, technician training, quality control, warranty verification, insurance, or dispute-resolution purposes.

    Mount Mob will not use photographs that clearly identify a Customer or private personal information for advertising or promotional purposes without permission where such permission is required by law.

  24. 24. Customer Communications

    By providing a phone number or email address, the Customer authorizes Mount Mob to send communications reasonably related to the requested Services, including:

    • booking confirmations;
    • appointment reminders;
    • arrival notifications;
    • quote updates;
    • payment or invoice notifications;
    • service follow-ups.

    Marketing communications, if any, will be handled in accordance with applicable law and applicable opt-out requirements.

  25. 25. Indemnification

    To the fullest extent permitted by law, the Customer agrees to indemnify and hold harmless Mount Mob and its owners, employees, contractors, and agents from third-party claims, damages, losses, liabilities, and reasonable costs arising from:

    • the Customer's breach of these Terms;
    • inaccurate or misleading information provided by the Customer;
    • lack of authority to authorize work at the Property;
    • unsafe or undisclosed Property conditions;
    • Customer-supplied equipment;
    • modifications performed by the Customer or third parties after Mount Mob completes the Services;
    • the Customer's violation of applicable law or third-party rights.

    This provision does not require the Customer to indemnify Mount Mob for Mount Mob's own gross negligence or willful misconduct where prohibited by law.

  26. 26. Warranty Disclaimer

    EXCEPT FOR ANY EXPRESS WORKMANSHIP WARRANTY PROVIDED IN THESE TERMS, AND TO THE FULLEST EXTENT PERMITTED BY LAW, SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

    MOUNT MOB DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

    Nothing in these Terms limits any warranty or consumer right that cannot legally be waived.

  27. 27. Limitation of Liability

    TO THE FULLEST EXTENT PERMITTED BY LAW, MOUNT MOB WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES.

    MOUNT MOB WILL NOT BE LIABLE FOR LOSS OF USE, LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR SIMILAR CONSEQUENTIAL LOSSES.

    EXCEPT WHERE PROHIBITED BY LAW, MOUNT MOB'S AGGREGATE LIABILITY ARISING FROM A PARTICULAR SERVICE ORDER WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE CUSTOMER TO MOUNT MOB FOR THE SERVICES GIVING RISE TO THE CLAIM.

    These limitations do not apply where liability cannot legally be limited, including where applicable law provides otherwise for gross negligence, willful misconduct, fraud, or personal injury.

  28. 28. Force Majeure

    Mount Mob will not be liable for delays or failure to perform caused by circumstances beyond its reasonable control, including severe weather, natural disasters, fires, government actions, utility failures, transportation disruptions, supply shortages, labor disruptions, emergencies, or other events beyond Mount Mob's reasonable control.

    If such an event affects an appointment, Mount Mob may reschedule the affected Services.

  29. 29. Dispute Resolution

    Before initiating formal proceedings, the Customer and Mount Mob agree to make reasonable efforts to resolve any dispute informally.

    The Customer may contact Mount Mob at hello@mountmob.com.

    If the dispute cannot be resolved informally, disputes will be handled according to the dispute-resolution procedures permitted by the laws of [STATE].

  30. 30. Governing Law

    These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law principles.

    Any court proceeding permitted under these Terms will take place in a court of competent jurisdiction located in [COUNTY, STATE], unless applicable consumer law requires otherwise.

  31. 31. Changes to These Terms

    Mount Mob may update these Terms periodically.

    The "Last updated" date at the top of this page identifies the most recent revision.

    Changes will apply prospectively unless otherwise required by law.

    For bookings already confirmed, the version of the Terms in effect when the booking was made will generally govern that booking unless the Customer agrees to updated Terms.

  32. 32. Entire Agreement

    These Terms, together with any applicable quote, invoice, booking confirmation, written scope of work, warranty terms, or other written agreement between Mount Mob and the Customer, constitute the agreement governing the Services.

    If a separately signed written agreement conflicts with these Terms, the separately signed agreement controls to the extent of the conflict.

  33. 33. Waiver

    Failure by Mount Mob to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

    A waiver is effective only when made in writing by an authorized representative of Mount Mob.

  34. 34. Severability

    If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable where permitted by law.

    The remaining provisions will remain in full force and effect.

  35. 35. Assignment

    The Customer may not assign rights or obligations under these Terms without Mount Mob's prior written consent.

    Mount Mob may assign its rights or obligations in connection with a merger, acquisition, sale of assets, corporate restructuring, or transfer of its business, subject to applicable law.

  36. 36. Survival

    Sections that by their nature should survive completion or termination of Services will survive, including provisions regarding payment obligations, intellectual property, indemnification, warranty limitations, limitation of liability, dispute resolution, and governing law.
